Our total liability shall not exceed the amount paid (if any) by you to SLM.COM in the 12 months preceding the claim.
11. Dispute Resolution and Binding Arbitration
11.1 Informal Resolution First
Before initiating arbitration, you agree to contact us at legal@slm.com and attempt to resolve the dispute informally.
We will make a good‑faith effort to resolve disputes within 30 days.
11.2 Binding Arbitration
If a dispute cannot be resolved informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration, rather than in court, except as noted below.
Arbitration will be conducted:
- By a single arbitrator
- Under the rules of the American Arbitration Association (AAA) or a comparable arbitration body
- In Arizona, unless the parties agree otherwise
Judgment on the arbitration award may be entered in any court with jurisdiction.
11.3 Waiver of Jury Trial and Class Actions
You and SLM waive any right to a jury trial.
You agree that disputes will be resolved on an individual basis only, and not as part of a class, collective, or representative action.
11.4 Exceptions
Either party may bring claims in small claims court if the claims qualify.
Either party may also seek injunctive or equitable relief for misuse of intellectual property or unauthorized access to the Services.
12. Indemnification
You agree to indemnify and hold harmless SLM.COM from any claims, damages, or expenses arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any applicable law or rights of others
13. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
14. Changes to These Terms
We may update these Terms from time to time.
Changes will be posted on this page with an updated effective date. Continued use of the Services constitutes acceptance of the updated Terms.
